1. About Gammen

Gammen is an AI-powered creative platform that allows users to generate images and videos, create reusable characters, edit footage and produce digital content.

Gammen is operated under the Gammen name in Victoria, Australia.

By using Gammen, you agree to these Terms of Service.

2. Accounts

You must provide accurate registration information, maintain the security of your account and take responsibility for activity occurring through it.

You must comply with all laws that apply to you, including any minimum-age requirements, and with the age requirements of the AI providers whose technology powers Gammen.

We may suspend accounts involved in fraud, unlawful activity, serious misuse or violations of these terms.

3. AI Creation and Editing

Gammen provides AI-assisted image generation, video generation and video editing, including reusable characters and lip-sync tools.

AI-generated results may vary. We do not guarantee that every generation will perfectly match a user's instructions or meet a particular artistic or commercial expectation.

Generation availability, processing times and output quality may vary according to the selected service and technical conditions.

4. Tokens and Subscriptions

Gammen uses tokens to access eligible AI generation and editing services.

• New eligible users currently receive 150 introductory tokens following the required account verification.
• Paid plans provide an allocated number of tokens according to the selected subscription.
• Additional token packages may be purchased when available.
• The token cost of a paid generation or edit is shown before you confirm it.
• Tokens are reserved when a generation starts. If a generation fails, the reserved tokens are released back to your balance and you are not charged for the unsuccessful output.
• Token allowances are shown in your account and at purchase.

Monthly plan tokens are reset to the plan allowance at each renewal; unused monthly tokens do not roll over. When a paid plan ends, its monthly tokens stop.

Purchased token packages do not expire and are not affected by plan renewal. Monthly plan tokens are used before purchased tokens.

Subscription fees and billing currencies are displayed before checkout.

5. Payments and Cancellation

Payments are processed through authorised payment providers, including Stripe.

Subscriptions renew according to the billing interval and conditions presented at checkout.

Customers may manage or cancel subscriptions through the available Account controls.

When you cancel, your subscription stops renewing but your paid access and remaining tokens continue until the end of the current billing period. After that, your account returns to the free plan.

Refunds and remedies are governed by our Refund & Cancellation Policy and applicable consumer protection laws.

6. Your Content and Intellectual Property

You retain ownership of intellectual property rights you lawfully hold in the material you upload.

You grant Gammen a limited permission to process, store and transmit your uploaded material as reasonably necessary to provide requested services.

Rights to AI-generated outputs and commercial usage depend on applicable law, the underlying AI providers' terms and any third-party rights.

You are responsible for everything you upload, including images, video, audio and prompts. You confirm that you own it or have all necessary permissions, copyright licences and consents (including from any person who appears in or is imitated by it) and that your use is lawful.

You may use generated content commercially only to the extent permitted by applicable law, the licence terms of the underlying third-party AI models and any third-party rights. Gammen does not guarantee that you will be the exclusive owner of generated content or that it can be used without restriction, and similar outputs may be produced for other users.

You must not upload or use content in a way that infringes copyright, privacy, publicity or other legal rights.

7. Acceptable Use

You must not use Gammen to:

• Create unlawful, fraudulent or deliberately deceptive material.
• Infringe another person's intellectual property or privacy rights.
• Create unauthorised impersonations or misleading identity-based content.
• Upload material you do not have permission to use.
• Attempt to bypass security, token restrictions or payment controls.
• Distribute unlawful, exploitative or abusive content.

Additional restrictions may apply under the terms of the AI providers integrated with Gammen.

8. EARN Program

Eligible users may participate in Gammen's EARN referral and reselling program.

The currently advertised commission is 50% of eligible subscription payments, subject to the program's applicable eligibility rules.

Commissions may be subject to a seven-day holding period, payment verification and applicable refund or reversal adjustments.

Payouts are made to a PayID or PayPal account that you provide. No other payout methods are offered.

Participants are responsible for their own applicable tax obligations.

Commissions are calculated on eligible subscription payments, including renewals, while the referred customer remains subscribed. A commission linked to a payment that is later refunded, reversed or charged back is cancelled.

A payout is requested from your Earn page and is reviewed and processed by Gammen. Payouts are not automatic or instant. No minimum payout or additional payout fee applies beyond the rules stated here.

Earnings are not guaranteed.

9. Service Availability

We aim to provide a reliable service but cannot guarantee uninterrupted availability.

Temporary interruptions may occur because of maintenance, third-party outages or technical failures.

Users should retain independent copies of important finished content.

10. Termination

You may stop using Gammen and cancel your subscription at any time from your Account page.

We may suspend or terminate access where these terms are breached, where there is fraud, unlawful activity or serious misuse, or where required by law. Where reasonable, we will tell you why.

Termination does not affect rights or remedies that have already arisen, including your rights under the Australian Consumer Law.

11. Consumer Rights and Liability

Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law.

To the extent permitted by law, Gammen is not responsible for losses arising from unlawful user activity, third-party service failures or uses outside the agreed service.

Any additional liability limitations must be consistent with applicable law.

12. Disputes

If you have a concern, please email support@gammen.com first so we can try to resolve it in good faith. This does not limit your right to seek other remedies or to contact a consumer protection authority.

13. Changes and Contact

Our privacy practices are described in our Privacy Policy, and refunds in our Refund & Cancellation Policy.

We may update these terms and will provide notice of material changes where required.

These terms are governed by applicable Australian law, with the courts of Victoria, Australia having jurisdiction.
